This Liability Waiver and Release Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Elite Responder Training LLC., its owners, instructors, officers, agents, contractors, affiliates, and volunteers (collectively referred to as “ERT”).
1. Acknowledgment of Risk
Participant understands and acknowledges that participation in training courses provided by ERT—including but not limited to CPR, AED use, First Aid, BLS, ACLS, PALS, PEARS, AVIRT, and related emergency response training—involves inherent risks.
These risks may include, but are not limited to:
Physical exertion and fatigue
Musculoskeletal strain or injury (including from CPR compressions or lifting)
Exposure to simulated or real-life emergency scenarios
Use of training equipment that may cause minor injury
Participant voluntarily assumes all risks, both known and unknown, associated with participation.
2. Medical Fitness
Participant certifies that they are physically and mentally capable of participating in the training. Participant agrees to:
Inform instructors of any medical conditions that may affect participation
Stop participation if they experience pain, dizziness, or distress
ERT is not responsible for evaluating Participant’s medical fitness.
3. Release of Liability
To the fullest extent permitted by law, Participant hereby releases, waives, and discharges ERT from any and all liability, claims, demands, or causes of action arising out of or related to:
Any injury, illness, or death occurring during or after participation
Any damage to personal property
Any alleged negligence of ERT
This release applies to all claims, including those based on negligence, except in cases of gross negligence or willful misconduct, where prohibited by law.
4. Indemnification
Participant agrees to indemnify and hold harmless ERT from any and all claims, damages, costs, or expenses (including attorney fees) arising from:
Participant’s actions during training
Participant’s misuse or misapplication of training
Participant’s failure to follow instruction
5. No Guarantee of Outcomes
Participant understands and agrees:
Completion of training does not guarantee competency in real-world emergencies
ERT does not guarantee successful outcomes when skills are applied
Participant is solely responsible for their actions in any real-life emergency situation
6. Future Use of Training / Third-Party Liability
Participant acknowledges that:
ERT is not responsible for how training is applied after course completion
ERT is not liable for any injury, death, or damages resulting from Participant’s actions or inactions in real-world scenarios
Participant assumes full responsibility for decisions made when rendering aid
7. Compliance with Laws and Good Samaritan Protections
Participant understands that emergency response actions are governed by:
ERT makes no guarantees regarding legal protection in any specific situation.
8. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Tennessee.
